Detailed Analysis

Article 48 mandates close cooperation between national competent authorities (NCAs) and the European Supervisory Authorities (ESAs) to ensure that DORA is applied effectively and consistently across the EU. Given that many financial entities and ICT third-party providers operate across borders, uncoordinated supervision would create gaps, overlaps, and inconsistencies.

The cooperation framework includes mechanisms for exchanging information relevant to supervisory assessments, sharing best practices in enforcement, and coordinating supervisory activities where multiple authorities have jurisdiction over the same entity or group. This is particularly important for large banking groups and pan-European financial market infrastructures.

The ESAs play a coordinating role, promoting supervisory convergence and facilitating the resolution of disputes between NCAs where differing interpretations or approaches could undermine the level playing field that DORA seeks to establish.
